Two federal RICO complaints, two different courts, two different fraud theories — filed within four days of each other. That is not a coincidence. That is a strategic shift.
These are not related cases. The Allstate complaint is about medical billing fraud in Texas. The Uber complaint is about staged collisions in New York. The companies involved do not share counsel, do not share defendants, and are not coordinating litigation strategy. What they share is a decision: take documented fraud patterns out of the claims cost column and put them into federal court under RICO.
The Racketeer Influenced and Corrupt Organizations Act was originally designed to target organized crime. Its civil provisions, codified at 18 U.S.C.
